Terms of Service

1. Acceptance of Terms
By accessing or using the APPIHIRE platform (“the Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Platform.
APPIHIRE (Pty) Ltd (“we”, “us”, “our”) operates this platform. These Terms constitute a legally binding agreement between you and APPIHIRE in accordance with South African law.
2. Eligibility
To use APPIHIRE, you must:
- Be at least 18 years of age.
- Be a South African resident or have legal authorization to work in South Africa.
- Provide accurate, current, and complete information during registration.
- Not be prohibited from using the Platform under any applicable law.
3. Accounts and Registration
You must create an account to use the Platform. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
- Workers must complete identity verification (via VerifyNow OCR) to access full platform features.
- Employers must provide valid business or personal details and a working payment method.
- Franchise operators are onboarded by APPIHIRE admin and operate under a separate franchise agreement.
You must notify us immediately of any unauthorized access to your account at appihirecloud@gmail.com.
4. Platform Services
APPIHIRE provides the following services:
- Job marketplace: Employers post jobs; workers apply or are hired directly.
- Identity verification: Worker identity is verified through government ID OCR and biometric face matching.
- Escrow payments: Employer funds are held in escrow via PayFast until job completion.
- In-platform messaging: Text, voice notes, and video calls between workers and employers.
- Worker ratings: Mutual rating system after completed jobs.
- Franchise management: Territory-based operators manage local workforces.
5. Fees and Payment
APPIHIRE charges a platform fee of 10% on the agreed worker rate for once-off and fixed-term jobs. Additional fees may apply:
- Fixed-term booking fee: R100 added to escrow at acceptance.
- Permanent placement: R250 finder fee charged on job completion.
- Sponsorship: R1,500 sponsorship fee for employer-sponsored workers.
All payments are processed through PayFast. Funds are held in escrow and released to the worker upon confirmed job completion. Disputed payments are subject to our dispute resolution process.
6. Worker Obligations
As a worker on APPIHIRE, you agree to:
- Provide truthful identity documents and profile information.
- Complete jobs to the agreed standard and within the agreed timeframe.
- Check in and out using GPS location services when required.
- Record a voice agreement before starting work.
- Not engage in fraud, misrepresentation, or unsafe conduct.
- Maintain an accurate skills profile and availability status.
7. Employer Obligations
As an employer on APPIHIRE, you agree to:
- Post accurate job descriptions with fair and lawful requirements.
- Fund escrow before a worker begins any job.
- Confirm job completion honestly and release payments promptly.
- Provide a safe working environment compliant with South African labour law.
- Not discriminate against workers on any prohibited ground.
- Not attempt to circumvent the platform to avoid fees.
8. Escrow, Cancellations and Refunds
Employer payments are held in a trusted escrow account until the job is confirmed complete. The following cancellation and refund rules apply:
Employer-initiated cancellation:
- Cancelled before a worker accepts: full refund of escrow, no platform fee charged.
- Cancelled after acceptance but before work starts: escrow refunded minus the platform fee (10% of agreed rate). Fixed-term booking fee (R100) is non-refundable.
- Cancelled after work has started (in-progress): employer must raise a dispute. Refunds are at APPIHIRE’s discretion following investigation.
Worker-initiated cancellation:
- If the worker withdraws their application before acceptance: no charge to any party.
- If the worker cancels after acceptance: employer receives a full escrow refund. The worker’s account may be flagged and their rating affected.
- Repeated worker cancellations may result in account suspension.
Refund timelines:
- Wallet refunds are processed within 1–3 business days of cancellation confirmation.
- Refunds to the original payment method (PayFast) may take 5–10 business days depending on your bank.
9. Return and Satisfaction Policy
APPIHIRE is a labour marketplace — we connect workers and employers but do not provide the services directly. As such, “returns” are addressed through our dispute and resolution process.
If you are unsatisfied with a completed job:
- Raise a dispute within 48 hours of marking the job as complete. Disputes raised after this window will not qualify for a refund.
- Submit evidence (photos, messages, voice recordings) to support your claim via the Platform.
- APPIHIRE will review the evidence within 5 business days and make a determination.
Possible outcomes of a dispute:
- Partial refund: Where work was partially completed to standard.
- Full refund: Where work was not performed or materially failed to meet the agreed scope.
- Payment released to worker: Where evidence supports the worker’s claim of completion.
APPIHIRE’s decision on disputes is final and binding. Platform fees are non-refundable once a job has been marked complete or where a dispute is resolved in the worker’s favour.
For permanent placement jobs, the R250 finder fee is non-refundable once the worker has started employment, regardless of subsequent termination by either party.
10. Dispute Resolution
Disputes between workers and employers should first be raised through the Platform’s dispute mechanism. APPIHIRE will attempt to mediate and resolve disputes fairly. If mediation fails, either party may refer the matter to the relevant South African authority (e.g., CCMA for labour disputes, or small claims court).
11. Prohibited Conduct
You may not:
- Use the Platform for any illegal purpose or in violation of any law.
- Submit false identity documents or impersonate another person.
- Harass, threaten, or discriminate against other users.
- Attempt to hack, disrupt, or gain unauthorized access to the Platform.
- Scrape, copy, or extract data from the Platform without written consent.
- Post jobs that are fraudulent, misleading, or violate labour laws.
- Circumvent escrow payments or attempt off-platform transactions to avoid fees.
12. Termination and Suspension
APPIHIRE may suspend or terminate your account at any time if you breach these Terms, engage in fraudulent activity, or are subject to a legal obligation. Upon termination:
- Active jobs will be cancelled and escrow funds returned per our refund policy.
- You may request withdrawal of any remaining wallet balance.
- Your data will be handled in accordance with our Privacy Policy.
13. Intellectual Property
All content, branding, logos, and software on the APPIHIRE platform are the intellectual property of APPIHIRE (Pty) Ltd. You retain ownership of content you submit (e.g., profile information, job postings) but grant APPIHIRE a non-exclusive license to display and use that content as necessary to operate the Platform.
14. Limitation of Liability
APPIHIRE acts as an intermediary between workers and employers. We do not guarantee the quality, safety, or legality of services provided by workers or the accuracy of employer job postings. To the maximum extent permitted by law, APPIHIRE shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform.
Our total liability for any claim shall not exceed the amount of fees you have paid to APPIHIRE in the 12 months preceding the claim.
15. Indemnification
You agree to indemnify and hold harmless APPIHIRE, its directors, employees, and franchise operators from any claims, losses, damages, or expenses (including legal fees) arising from your use of the Platform, your breach of these Terms, or your violation of any law or third-party right.
16. Franchise Operators
Franchise operators are independent contractors who operate under a franchise agreement with APPIHIRE. They are responsible for managing workers and employers within their designated territory. APPIHIRE is not liable for the acts or omissions of franchise operators beyond what is expressly stated in these Terms.
17. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email or in-platform notification at least 14 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
18. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the South African courts.
